THIS NOTICE DESCRIBES HOW YOUR HEALTH INFORMATION MAY BE USED AND DISCLOSED AND HOW YOU CAN ACCESS IT. PLEASE REVIEW IT CAREFULLY.
1. Introduction and Scope
This Notice of Privacy Practices (“Notice”) describes how Tyde Wellness, LLC (“Tyde Wellness,” “we,” “our,” or “us”) may use and disclose your protected health information (“PHI”) in connection with our services and how you can exercise your rights regarding that information.
Tyde Wellness is not a medical provider and does not provide medical services. We are a management services organization (MSO) that contracts with independent, licensed healthcare providers (“Healthcare Providers”) who are responsible for the delivery of all medical services, including prescribing medications and providing treatment.
Tyde Wellness is not a covered entity under the Health Insurance Portability and Accountability Act (“HIPAA”). However, we voluntarily adhere to industry best practices regarding the protection of health-related information. Any PHI collected, stored, or processed through our Platform is handled exclusively by third-party Healthcare Providers, pharmacies, and laboratories, who are directly responsible for ensuring compliance with HIPAA and other applicable laws.
This Notice applies to the administrative coordination services provided by Tyde Wellness and governs the limited data that we may collect and process to facilitate access to third-party medical services.
2. Protected Health Information (PHI)
“Protected health information” (PHI) refers to personally identifiable health data, including but not limited to your medical history, treatment details, prescription records, and payment information related to healthcare services. While PHI is primarily managed by third-party Healthcare Providers, Tyde Wellness may process limited administrative data necessary for appointment scheduling, billing, and customer support.
3. How We Use and Disclose PHI
A. Uses and Disclosures for Coordination of Services
Tyde Wellness may use or disclose your PHI only as necessary to facilitate administrative tasks related to your healthcare, including but not limited to:
Scheduling and Coordinating Services: Sharing limited information with Healthcare Providers, pharmacies, or laboratories to facilitate your requested services.
Billing and Payment Processing: Providing transaction details to third-party payment processors to facilitate membership subscriptions and service payments.
Customer Support and Member Inquiries: Responding to requests for administrative support regarding your membership, payments, or service access.
B. Uses and Disclosures by Healthcare Providers (Not Controlled by Tyde Wellness)
Your PHI is primarily managed by the Healthcare Providers, pharmacies, and laboratories that provide medical services to you. These entities are responsible for:
Treatment Decisions: Diagnosing, prescribing medications, and providing medical guidance.
Medical Records Management: Storing and protecting PHI as required by HIPAA and state laws.
Compliance with Regulatory Requirements: Reporting to public health agencies, responding to law enforcement requests, and fulfilling legal obligations.
Tyde Wellness does not have access to, nor does it control, your complete medical records. Any requests related to accessing or modifying your medical information should be directed to the Healthcare Provider who rendered your care.
4. Uses and Disclosures That Do Not Require Your Authorization
Tyde Wellness may disclose your information only as required by law or in the following limited circumstances:
To Comply with Federal, State, or Local Laws.
For Public Health Reporting, Audits, and Investigations.
In Response to Legal Requests, Such as Court Orders or Subpoenas.
For Billing and Payment Processing Through Third-Party Vendors.
We will not use or disclose PHI for any unauthorized purposes, including marketing or fundraising, without your explicit consent.
5. Your Rights Regarding Your PHI
A. Right to Access and Request Copies
You have the right to request a copy of your PHI. Since Tyde Wellness does not store complete medical records, requests should be directed to the Healthcare Provider who provided your care.
B. Right to Amend or Correct PHI
If you believe your PHI contains errors, you may request an amendment. However, this request must be submitted to the Healthcare Provider or entity responsible for maintaining your records.
C. Right to Restrict Certain Disclosures
You may request limitations on how your PHI is disclosed. While Tyde Wellness will honor reasonable requests, some restrictions may not be possible due to legal requirements.
D. Right to Request Confidential Communications
You may request to receive communications via alternative means (e.g., mail instead of email). We will accommodate reasonable requests.
6. Breach Notification
If a breach of PHI occurs within Tyde Wellness’s administrative data systems, we will notify affected individuals within 60 days of discovery.
If a PHI breach occurs within a Healthcare Provider’s system, pharmacy, or laboratory, the responsible entity will notify affected individuals as required by HIPAA.
7. Medicare/Medicaid Exclusion and Financial Responsibility
Neither Tyde Wellness nor its contracted Healthcare Providers participate in Medicare, Medicaid, or any federal or state healthcare program. Users are solely responsible for all payments related to services provided.
